Callup.gg ("Callup," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, and equivalent provisions of the Copyright Act (Canada), we will respond promptly to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.
If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement on the Callup platform, please follow the procedures outlined below.
To submit a DMCA takedown notice, please provide our designated DMCA Agent with the following information in writing:
Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
Identification of the infringing material — A description of the material you claim is infringing and its location on the Callup platform, with sufficient detail to allow us to locate it (e.g., a URL or clip ID).
Your contact information — Your name, mailing address, telephone number, and email address.
Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
Accuracy statement — A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Your signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

We aim to process valid takedown notices within 2 business days. Upon receipt of a valid notice, we will promptly remove or disable access to the allegedly infringing material and notify the user who posted it.
If you believe that material you posted on Callup was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our DMCA Agent. Your counter-notification must include:
Identification of the removed material — A description of the material that was removed or disabled and its location on Callup before it was removed (e.g., a URL or clip ID).
Your statement under penalty of perjury — A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your contact information — Your name, mailing address, telephone number, and email address.
Consent to jurisdiction — A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Callup may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Your signature — A physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original takedown notice. If the original party does not file a court action seeking to restrain the allegedly infringing activity within 10 business days, we will restore the removed material.
Callup maintains a policy of terminating the accounts of users who are repeat copyright infringers, in appropriate circumstances. If a user receives multiple valid DMCA takedown notices, their account may be suspended or permanently terminated at our sole discretion. We track and count valid takedown notices per account when making these determinations.
Please be aware that under Section 512(f) of the DMCA and equivalent Canadian provisions, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
Before submitting a DMCA notice or counter-notification, please carefully consider whether the use of the material at issue constitutes fair use or fair dealing, as a misrepresentation could result in legal consequences.
